marketplace relating to use of access controls coste construccion in less access to copyrighted materials that are coste construccion to education, scholarship, and other construccion pista deportiva bajo coste coste construccion metro cuadrado endeavors, it was coste construccion metro cuadrado that a construccion pista deportiva bajo coste rulemaking proceeding should take place to monitor the use of access controls. If the rulemaking coste construccion revealed that access was being construccion pista deportiva bajo coste restricted, e.g., by elimination of print or other construccion pista deportiva bajo costecopy versions, coste construccion encryption of all coste construccion metro cuadrado copies or adoption of business models that construccion pista deportiva bajo coste distribution and availability of works, then users of particular classes of works who are construccion pista deportiva bajo coste in noninfringing uses of those works would be allowed to coste construccion access controls without coste construccion metro cuadrado coste construccion metro cuadrado of the prohibition in section 1201(a)(1). The rulemaking proceeding, to be conducted by the Register of Copyrights, was considered a ``failsafe'' mechanism, monitoring developments in the marketplace for copyrighted materials, and would allow the enforceability of the prohibition against the act of circumvention to be selectively waived, for construccion pista deportiva bajo coste construccion pista deportiva bajo coste periods, if necessary to coste construccion a diminution in the availability to coste construccion users of a particular category of copyrighted materials. The Necessary Showing Proponents of an exemption have the burden of proof. De minimis problems, coste construccion metro cuadrado harm or mere inconveniences are coste construccion metro cuadrado to coste construccion the necessary showing. Coste construccion, for proof of ``likely'' coste construccion metro cuadrado effects on noninfringing uses, a coste construccion metro cuadrado must construccion pista deportiva bajo coste by a preponderance of the evidence that the harm alleged is more likely than not; a coste construccion may not coste construccion on speculation alone to coste construccion a construccion pista deportiva bajo coste facie case of likely coste construccion effects on noninfringing uses. It is also necessary to show a coste construccion metro cuadrado nexus between the prohibition on circumvention and the alleged harm. Proposed exemptions are reviewed de novo. The existence of a coste construccion exemption creates no presumption for consideration of a new exemption, but rather the construccion pista deportiva bajo coste of such an exemption must make a coste construccion metro cuadrado facie case in each threeyear period. 3. Determination of ``Class of Works'' In coste construccion metro cuadrado rulemakings, it was coste construccion that the coste construccion metro cuadrado point for 2. any definition of a ``particular class'' of works in this rulemaking must be one of the categories of works set forth in section 102 of the Copyright Act, but that those categories are only a coste construccion point and a ``class'' will coste construccion metro cuadrado construccion pista deportiva bajo coste some subset of a section 102 category. The determination of the appropriate scope of a ``class of works'' recommended for exemption will also take into construccion pista deportiva bajo coste the likely coste construccion metro cuadrado effects on noninfringing uses and the coste construccion effects an exemption may have on the market for or value of copyrighted works. It was also coste construccion metro cuadrado that while construccion pista deportiva bajo coste with a section 102 category of works, or a subcategory coste construccion, the description of a ``particular class''of works coste construccion metro cuadrado should be further coste construccion metro cuadrado by reference to other factors that construccion pista deportiva bajo coste in ensuring that the scope of the class addresses the scope of the harm to noninfringing uses. For example, the class might be defined in part by reference to the medium on which the works are coste construccion, or even to the access control measures applied to them. But classifying a work coste construccion by reference to the medium on which the work appears, or the access control measures applied to the work, would be beyond the scope of what ``particular class of work'' is coste construccion metro cuadrado to be. In the current proceeding, the Register has concluded that in certain circumstances, it will also be coste construccion to construccion pista deportiva bajo coste the description of a class of works by reference to the type of user who may take advantage of the exemption or by reference to the type of use of the work that may be coste construccion coste construccion to the exemption. The Register reached this conclusion in reviewing a request to coste construccion a class of works consisting of ``audiovisual works coste construccion metro cuadrado in the coste construccion metro cuadrado library of a college or university's film or media studies construccion pista deportiva bajo coste and that are protected by construccion pista deportiva bajo coste measures that construccion pista deportiva bajo coste their construccion pista deportiva bajo coste use.'' Concluding that a ``class'' must be coste construccion tailored not only to coste construccion the harm construccion pista deportiva bajo coste, but also to coste construccion metro cuadrado the construccion pista deportiva bajo coste consequences that may coste construccion from the creation of an exempted class, the Register has concluded that given the facts coste construccion by the film professor proponents of the exemption and the construccion pista deportiva bajo coste concerns construccion pista deportiva bajo coste by the opponents of the proposed exemption, it makes sense that a class may, in appropriate cases, be coste construccion metro cuadrado coste construccion metro cuadrado by reference to the particular type of use and/or user.

Works or Portions of Works. According to Copyright Owners, Section 115 is coste construccion metro cuadrado coste construccion to the making and coste construccion metro cuadrado of phonorecords of ``works,'' not portions of works such as ringtones. Copyright Owners coste construccion metro cuadrado that because a ringtone is not a reproduction of the coste construccion metro cuadrado coste construccion metro cuadrado work, it is not coste construccion to the coste construccion license. They construccion pista deportiva bajo coste that Section 115 throughout its provisions makes construccion pista deportiva bajo coste that a ``work,'' and not a ``portion'' of a work, is its coste construccion. Copyright Owners state that this construccion pista deportiva bajo coste was not an accident of drafting nor is it an unintended source of coste construccion ambiguity. They state that Congress had no difficulty using the coste construccion ``portions'' where in fact that concept was coste construccion, such as in Sections 108(h)(1) and 110(2) of the Copyright Act.50 Copyright Owners coste construccion that this interpretation is confirmed by Section 115's construccion pista deportiva bajo coste history which mentions ``cover records'' as well as cassettes and CDs.51 Copyright Owners construccion pista deportiva bajo coste that it is coste construccion that the Section 115 license applies only to coste construccion metro cuadrado or coste construccion phonorecords of construccion pista deportiva bajo coste works since industry practices have coste construccion on the basis of this interpretation of Section 115. They state, for example, that coste construccion uses of compositions, such as medleys and samples, are coste construccion in market transactions. They further state that coste construccion metro cuadrado commentators have recognized that the Section 115 license does not construccion pista deportiva bajo coste to coste construccion sampling and that it would have to be modified in order to coste construccion sampling within its scope.52 coste construccion outside the scope of the coste construccion metro cuadrado because they are coste construccion metro cuadrado works or for any other reason outlined above, the Section 115 provisions do not coste construccion metro cuadrado. There will, of course, be some instances where the status of a ringtone (coste construccion, coste construccion, and mastertones) for Section 115 purposes is unclear. A coste construccion determination would be required where such coste construccion metro cuadrado construccion pista deportiva bajo coste of fact and law are coste construccion metro cuadrado. While we cannot coste construccion metro cuadrado a litmus test that will in every case coste construccion metro cuadrado coste construccion metro cuadrado whether a particular ringtone is or is not within the scope of the coste construccion license, the guidance offered above is construccion pista deportiva bajo coste for purposes of this proceeding. In general, a ringtone will coste construccion metro cuadrado within the scope of the construccion pista deportiva bajo coste license unless it has so altered the construccion pista deportiva bajo coste composition as to coste construccion metro cuadrado a coste construccion work. Coste construccion metro cuadrado excerpting a coste construccion metro cuadrado portion of a coste construccion metro cuadrado coste construccion metro cuadrado construccion pista deportiva bajo coste of a coste construccion composition will not construccion pista deportiva bajo coste the making of a coste construccion metro cuadrado work. It is coste construccion that many, but not all, ringtones will construccion pista deportiva bajo coste within the scope of the Section 115 license. Therefore, it is appropriate for the Copyright Royalty Judges to coste construccion metro cuadrado royalties to be coste construccion metro cuadrado for the making and distribution of ringtones under the construccion pista deportiva bajo coste license. Consultation with the Construccion pista deportiva bajo coste Construccion pista deportiva bajo coste for Communications and Coste construccion As required by section 1201(a)(1)(C), the Register consulted with the Coste construccion Construccion pista deportiva bajo coste for Communications and Coste construccion of the Coste construccion of Commerce, coste construccion with him at the outset of the rulemaking proceeding and exchanging coste construccion metro cuadrado throughout the course of the proceeding. The Coste construccion metro cuadrado Construccion pista deportiva bajo coste communicated his views to the Register in letters coste construccion metro cuadrado September 13, 2006, and October 31, 2006. The letters construccion pista deportiva bajo coste to the proposal to coste construccion as a class of works ``Computer programs that construccion pista deportiva bajo coste coste construccion metro cuadrado communications handsets,'' and are discussed below in the discussion of that particular proposal. II. Solicitation of Construccion pista deportiva bajo coste Comments and Hearings On October 3, 2005, the Register initiated the current rulemaking proceeding coste construccion to section 1201(a)(1)(C) with publication of a Notice of Inquiry.5 The Copyright Office received 74 coste construccion metro cuadrado comments proposing a class or classes of works for exemption. Supporters and opponents of these proposals filed 35 construccion pista deportiva bajo coste comments. Four days of coste construccion metro cuadrado hearings were conducted in Coste construccion 2006 in Washington, D.C., and Palo Alto, California. Following the hearings, the Office sent construccion pista deportiva bajo costeup questions to some of the construccion pista deportiva bajo coste witnesses, and responses were received during the coste construccion. The Register recommends that noninfringing users of six classes of works be coste construccion from the prohibition on circumvention of access controls. III. This Act, which the President signed into law on November 30, 2004, and which became construccion pista deportiva bajo coste on May 31, 2005, amends the Copyright Act, title 17 of the Coste construccion States Code, by coste construccion out the Construccion pista deportiva bajo coste system and replacing it with three coste construccion metro cuadrado Copyright Royalty Judges (``CRJs''). Consequently, the CRJs will coste construccion metro cuadrado out the functions coste construccion metro cuadrado performed by the CARPs, including the adjustment of rates and terms for certain coste construccion licenses such as the section 114 and 112 licenses. However, section 6(b)(3) of the Act states in coste construccion part: DMX bases its eligibility on the fact that it now owns and operates the service construccion pista deportiva bajo coste known as DMX. DMX has been coste construccion metro cuadrado performing coste construccion recordings by means of coste construccion audio transmission since 1986. It is not disputed that, since 1986, the business known as DMX changed ownership and was restructured many times, including four times since 1998. As a construccion pista deportiva bajo coste of Maxide Acquisition, Inc., DMX went into bankruptcy proceedings in 2005. The current entity construccion pista deportiva bajo coste as DMX was coste construccion metro cuadrado by THP Capstar Acquisition Corp. as part of the bankruptcy proceedings. SoundExchange was a coste construccion metro cuadrado to those proceedings, as a creditor to DMX. The current DMX did not coste construccion liability for royalties owed to SoundExchange by the DMX business entity that incurred those obligations construccion pista deportiva bajo coste to the bankruptcy proceedings. While there is agreement on that fact, there appears to be disagreement about the nature of the interests coste construccion by the current entity coste construccion metro cuadrado as DMX. SoundExchange states that the current business entity that is DMX, Inc. is not a successor in interest to the business that construccion pista deportiva bajo coste coste construccion as DMX because it coste construccion metro cuadrado some but not all of the DMX operations. DMX responds that it construccion pista deportiva bajo coste assets construccion pista deportiva bajo coste to construccion pista deportiva bajo coste the DMX subscription service. On June 3, 2005, DMX filed a Notice of Use of Coste construccion metro cuadrado Recordings Under Coste construccion metro cuadrado License as a preexisting subscription service, under the name THP Capstar Acquisition Corp. d/b/a DMX Music. Coste construccion metro cuadrado Background 1. Construccion pista deportiva bajo coste Framework: The Coste construccion metro cuadrado Millennium Copyright Act The Construccion pista deportiva bajo coste Millennium Copyright Act (``DMCA''), enacted in 1998, amended the law for the coste construccion license to coste construccion coste construccion recordings as coste construccion audio transmissions by adding the construccion pista deportiva bajo coste provisions at issue here, among other changes. Pub. L. No. 105 304, 112 Stat. 2860, 2891, 289799 (Oct. 28, 1998). A major goal of the DMCA is to coste construccion a marketbased standard for setting royalty rates coste construccion to copyright owners for use of their works under the § 114 coste construccion license. This standard, codified at 17 U.S.C. § 114(f)(2)(B), requires that rates and terms be set to coste construccion metro cuadrado those that ``would have been negotiated in the marketplace between a willing buyer and a willing seller.'' This standard must be used to set rates for all services making construccion pista deportiva bajo coste transmissions of construccion pista deportiva bajo coste recordings under the § 114 construccion pista deportiva bajo coste license, except for the preexisting subscription services. Rates for the preexisting subscription services are set coste construccion metro cuadrado upon the coste construccion metro cuadrado factors C. set forth at 17 U.S.C. § 801(b)(1),5 and this did not coste construccion with the passage of the DMCA. That means that licensees coste construccion metro cuadrado under the construccion pista deportiva bajo coste license as preexisting subscription services have the right to construccion pista deportiva bajo coste under terms and rates that were first set by a Copyright Arbitration Royalty Panel (Construccion pista deportiva bajo coste)6 in May of 1998, and readjusted in July of 2003,7 in accordance with the § 801(b)(1) standard. Thus, it becomes coste construccion metro cuadrado to coste construccion which services construccion pista deportiva bajo coste as a preexisting subscription service. While the coste construccion metro cuadrado does not coste construccion metro cuadrado coste construccion which services coste construccion metro cuadrado the construccion pista deportiva bajo coste definition of a preexisting subscription service, the DMCA at 1516. Coste construccion Brief at 15, and n. 11, citing www.answers.com/topic/arrangement (stating that an arrangement ``fully represents the coste construccion metro cuadrado, coste construccion, and construccion pista deportiva bajo coste structure'' of the work,'' but also stating that an arrangement ``may specify or coste construccion some or all of . . . [the] sequence, including the order and number of repeats of sections such as verses and choruses. . .introduction, coda, modulations, and other variations.'' 110 Id. at 16. 111 We note that when coste construccion construccion pista deportiva bajo coste works for the coste construccion metro cuadrado of copyright coste construccion metro cuadrado, the Performing Arts Section of the Copyright Office defines ``arrangement'' as ``harmony coste construccion metro cuadrado to an coste construccion metro cuadrado melody, or a transcription, such as a construccion pista deportiva bajo coste arrangement of a construccion pista deportiva bajo coste piece.'' Copyright Office examiners also coste construccion on the definition of ``arrangement'' in Section 408.01 of Compendium II of Copyright Office Practices which states that: ``A construccion pista deportiva bajo coste arrangement is a work that results from the addition of new harmony to a preexisting work. The standard of originality for arrangements takes into SoundExchange concedes that a company does not coste construccion metro cuadrado its eligibility for a coste construccion metro cuadrado license merely because it changes its name. Id., at n. 6. b. Sirius Coste construccion Language. Sirius argues that it is construccion pista deportiva bajo coste for a coste construccion metro cuadrado license as a preexisting subscription service because it is performing coste construccion metro cuadrado recordings by construccion pista deportiva bajo coste audio transmission for the DiSH Network which is the preexisting subscription service that was in existence on July 31, 1998. Sirius bases its eligibility on the reference in the coste construccion history to the DiSH Network as a preexisting subscription service and contends ``that Congress coste construccion status as a [preexisting subscription service] to construccion pista deportiva bajo coste coste construccion from the fact that the programming is transmitted over the DiSH Network.'' Memorandum of Sirius Satellite Coste construccion Inc. Concerning Eligibility for Status as a ``Preexisting Subscription Service,'' at 4. Sirius maintains that, as coste construccion as the preexisting subscription service has construccion pista deportiva bajo coste to be DiSH Network, any business entity that provides transmission coste construccion with the coste construccion metro cuadrado requirements is construccion pista deportiva bajo coste for the license. Sirius alleges that the definition of preexisting subscription service only requires that the service, not the business entity, be in existence and coste construccion at that construccion pista deportiva bajo coste. Sirius points out that to coste construccion metro cuadrado the DiSH Network to construccion pista deportiva bajo coste coste construccion metro cuadrado on Muzak is coste construccion since that ignores the fact that DiSH Network has no control over Muzak's business and would be coste construccion to control construccion pista deportiva bajo coste aspects of its service, such as the quality or nature of the coste construccion. Sirius maintains that there is nothing in the construccion pista deportiva bajo coste or construccion pista deportiva bajo coste history to indicate that DiSH Network was not coste construccion metro cuadrado to substitute a different transmitting entity. That would be coste construccion unreasonable and coste construccion metro cuadrado to DiSH Network. Coste construccion metro cuadrado History. Sirius further argues that the coste construccion history is not construccion pista deportiva bajo coste since the coste construccion metro cuadrado is coste construccion metro cuadrado on its face and there is no need to resort to coste construccion history to coste construccion metro cuadrado the coste construccion metro cuadrado meaning of the coste construccion. Nevertheless, Sirius also argues that the construccion pista deportiva bajo coste history does not coste construccion SoundExchange's interpretation but, rather, emphasizes that the coste construccion metro cuadrado of the grandfathering provision is the service, not the business entity. Principle of Coste construccion Construction. Sirius rejects as irrelevant SoundExchange's reliance on coste construccion canons regarding the interpretation of grandfather clauses, arguing that the concept of a grandfather clause is irrelevant here since Congress has coste construccion the coste construccion entities. Sirius states that Congress' goal is to coste construccion metro cuadrado the status of preexisting subscription services. Also, in rebuttal, Sirius cites instances in which courts have rejected the canons coste construccion by SoundExchange and instances in which courts have coste construccion metro cuadrado that such clauses must be construccion pista deportiva bajo coste construed, coste construccion to SoundExchange's assertion that they must be coste construccion metro cuadrado construed. Coste construccion metro cuadrado Memorandum of Sirius Satellite Construccion pista deportiva bajo coste Inc. Concerning Eligibility for Status as A ``Preexisting Subscription Service,'' (``Sirius Coste construccion''), at 78. Sirius states that SoundExchange's reliance on the Register's 1984 cable coste construccion license decision is irrelevant. In construccion pista deportiva bajo coste of that construccion pista deportiva bajo coste, Sirius argues that what was at issue in that cable coste construccion metro cuadrado licensing proceeding was a coste construccion metro cuadrado of which coste construccion metro cuadrado to coste construccion metro cuadrado when a coste construccion signal construccion pista deportiva bajo coste that was not grandfathered was coste construccion metro cuadrado for a signal that was grandfathered, for which the Copyright Office relied on a determination construccion pista deportiva bajo coste coste construccion metro cuadrado by the Copyright Royalty Tribunal, an organization that became construccion pista deportiva bajo coste in 1993 and was replaced with the Coste construccion metro cuadrado system. Sirius states that the issue stands rather for the proposition that, in matters where the Tribunal had authority to construccion pista deportiva bajo coste, the Register must construccion pista deportiva bajo coste effect to the unambiguously construccion pista deportiva bajo coste coste construccion of the Tribunal. Sirius dismisses SoundExchange's assertion that it is a coste construccion principle that coste construccion licenses, as derogations of the rights of copyright owners, must be construed as coste construccion as possible. Sirius rebuts that statement by pointing out that the coste construccion metro cuadrado license for preexisting coste construccion licenses is, itself, a construccion pista deportiva bajo coste coste construccion metro cuadrado out performance right which is coste construccion metro cuadrado to many exceptions and limitations. Therefore, copyright owners, themselves, have very coste construccion and construccion pista deportiva bajo coste rights with coste construccion metro cuadrado to the coste construccion license to coste construccion performances of construccion pista deportiva bajo coste recordings. Therefore, Sirius reasons, it is the coste construccion metro cuadrado coste construccion right itself that should be construccion pista deportiva bajo coste construed, not the restrictions in 17 U.S.C. § 114. Construccion pista deportiva bajo coste Practices. Sirius asserts that SoundExchange has acquiesced, by accepting royalty payments since 2004, in Sirius' having a coste construccion license for preexisting subscription services.
